- 1. FourSquare InvisalignTime Free Prize Draw Terms and Conditions (the “Promotion”) TERMS AND CONDITIONS These are the terms and conditions (the “Terms and Conditions”) that govern the relationship between you, the entrant (“you”, “your(s)”) and Align Technology Inc. of ALIGN TECHNOLOGY, B.V., Arlandaweg 161 1043 HS Amsterdam, NETHERLANDS (the “Promoter”, “we”, “our”, “us”). ELIGIBILITY 1. The Promotion is only open to residents in the UK aged eighteen (18) or over who have: (a) a valid and active FourSquare account and mobile access to such FourSquare account i.e. the FourSquare mobile app; (b) a valid and active Twitter account and mobile access to such Twitter account i.e. the Twitter mobile app; 2. The following are not eligible to participate in this Promotion: (i) employees of the Promoter, its respective subsidiaries and associated companies, any advertising and promotional agencies or the prize suppliers, the Participating Practitioners (defined in rule 4 below) (ii) immediate family members of such employees or of anyone with whom such employees are domiciled. In these Terms and Conditions, “immediate family” includes mother, father, brothers, sisters, sons, daughters, in laws, spouse or common law partners, (iii) existing Invisalign patients. 3. By entering the Promotion you agree that you have legal capacity to enter the Promotion and agree to the Terms and Conditions (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract). HOW TO ENTER 4. To participate in the Promotion you will need to, during the Promotion Period (defined in rule 6 below): (a) using your FourSquare app, check in to a venue nearby one of the participating orthodontists (listed in the schedule) ("Participating Practitioner(s)"); (b) tap the Explore tab in the FourSquare app and select the "Specials" category to see further details of this Promotion at the Participating Practitioner nearest to you ("Special"); (c) once you have seen the Special, you will need to check in to such Participating Practitioner; (d) using your Twitter app, publish your FourSquare check-in via a Tweet on Twitter and make sure you include the hashtag “#InvisalignTime” (each an "Entry", together the "Entries")
- 2. 5. There is no restriction on the number of Entries you can make, provided that each Entry relates to a different Participating Practitioner. Multiple Entries for the same Participating Practitioner will not count as multiple Entries to the Promotion and you can only win one (1) prize. 6. Please do not retweet each Entry more than once during the Promotion Period. Multiple retweets will not count as multiple Entries to the Promotion. PROMOTION PERIOD 7. The Promotion opens at 00:00:01 am (CET) on 15 July 2012 and closes when prizes run out (the “Promotion Period”). Only entries received by or on behalf of the Promoter during the Promotion Period and during the applicable Check in Periods will be accepted into the Promotion. PRIZE 8. There are a total of one hundred (100) prizes to be won in the UK. 9. Each winner will receive one (1) Spotify gift e-card for the sum of 25 GBP to cover a monthly subscription for a period of three (3) months at the Premium subscription level. 10. The prizes must be accepted as awarded and are non-transferable or convertible to cash or other substitutes. If due to circumstances beyond our control we are unable to provide the stated prizes, we reserve the right to award substitute prizes of equal or greater value. 11. All prizes are subject to the terms and conditions of the manufacturer or supplier. PRIZE ALLOCATION 12. The prize draw will take place on the last day of each month of the Promotion Period at the Promoter’s offices until prizes run out. The one hundred (100) winners will be selected at random in the presence of an independent observer from all valid and eligible Entries received during the Promotion Period in accordance with the Terms and Conditions through an electronic method. 13. We will endeavour to notify each winner via the private message function on Twitter within 15 days of the prize draw date. The winners need to accept their prize by returning a confirmation message via the private message function on Twitter to us within seven (7) days ("Winner Confirmation Message"). We will send out prizes within 7 days of receipt of such Winner Confirmation Messages to each winner's private message function on Twitter. 14. We reserve the right to select alternative winners in the event that: (a) a winner does not comply with these Term and Conditions or we have reasonable grounds for believing that a winner has contravened any of these Terms and Conditions; or (b) a winner does not comply with any terms, conditions and policies of any third party websites on or via which the Promotion is operated, including FourSquare and Twitter.

By participating in the Promotion, you agree to be bound by: (a) these Terms and Conditions (which may be amended or varied at any time by us with or without notice); (b) by our decisions and those of the Participating Practitioners, which are final in all matters relating to these Terms and Conditions, the Promotion, the winners' selection and no correspondence or discussion shall be entered into; and (c) any terms, conditions and policies of any third party websites on or via which the Promotion is operated, including FourSquare and Twitter. 17. All information provided by you in connection with this Promotion is provided to us directly and not to FourSquare or Twitter and this Promotion is in no way sponsored, endorsed or administrated by, or associated with FourSquare or Twitter. For the avoidance of doubt, FourSquare and Twitter shall have no responsibility or liability to you in respect of this Promotion. 18. All changes to the Terms and Conditions will be posted in revised Terms and Conditions on http://slidesha.re/NmPGMf (the “Promotion Website”). 19. To the extent permitted by applicable law, all Entries and Winner Confirmation Emails become our property and will not be returned. 20. We accept no responsibility for any incorrect or inaccurate information, for any error, omis- sion, interruption, deletion, defect, delay in operation or transmission, line failure, theft or de- struction or unauthorised access of FourSquare, Twitter and/or to Entries, for Entries lost or delayed whether or not arising during operation or transmission as a result of server func- tions, virus, bugs or other causes outside its control (to the fullest extent permitted by law) or attirubtable to FourSquare's platform and/or app or , Twitter's platform and/or app. We accept no responsibility for lost, stolen, delayed, damaged, misaddressed or misdirected Winner Confirmation Emails. Incomplete Entries will be disqualified. 21. Personal information collected from you will be used by us and the Participating Practitioners solely in connection with the Promotion and will not be disclosed to any third party except for the purpose of operating the Promotion and fulfilling prizes where applicable. The declared prize winners’ information will be shared by the Participating Practitioners with us, specifically the winner’s name, FourSquare username, date of birth and email address, only to the extent that this information is required to award the prizes for this Promotion. 22. By entering this Promotion, you agree to the use of your name, address, and or photograph or other likeness, as well as your appearance at publicity events without any additional compensation and as required by the Promoter if you are declared a winner. 23. These Terms and Conditions shall be governed by and construed in accordance with English law and any dispute arising out of or in connection with this Agreement shall be subject to the jurisdiction of the English Courts.
